Duties:
Reporting to the Site C Project Director, the Site C Commercial Manager will manage and lead a diverse team of Commercial Analysts, Schedulers, Cost Estimators, Risk Managers, In-house Legal Counsel, Insurance advisors, External Advisor, Subject Matter Experts and External Legal. The Site C Commercial Manager will work closely with Sub-Project Directors, Construction Managers, Sr. Contract Managers and Contract Professionals and provide commercial leadership on all Site C contracts with particular reference to the commercial aspects in order to ensure effective contractor performance in meeting project objectives through contractual terms and conditions.
Key Accountabilities:
* Leads and manages a multidiscipline group of BC Hydro Commercial Analysts, Schedulers, Cost Estimators, Risk Managers, In-house Legal Counsel, Insurance advisors, External Advisors, Subject Matter Experts and External Legal and works closely with Sr. Contract Managers and Contract Professionals. Coordinates with Construction Management and Managers within Engineering, Safety & Security, and Environment & Risk. * Manages complex, high risk commercial issues across contracts including disputes, negotiations and claims. * Proactively identify risks and mitigate issues to avoid claims and optimize project execution. * Interface with Sub-Project Directors, Contract Managers and Construction Director and escalate unresolved issues as appropriate. * Assemble and direct teams to resolve issues with support from Commercial Support team. * Lead teams to apply interdisciplinary approach to identify & assess risks * Responsible for analyzing issues, evaluating options and providing recommendations to management (cost, schedule, legal exposure) * Lead complex negotiations with contractors as required
* Ensure consistent methodology and processes for claims across the Project.
* Responsible for commercially supporting a portfolio of across Site C construction contracts
(including Main Civil Work, Generating Station & Spillway, Turbines & Generators, Balance of
Plant, Substation, and Transmission Lines)
* Provides input to and reviews contract documents with respect to commercial management cost,
scope, schedule and risk.
* Manages and maintains effective relationships with Project and Contract Representatives
associated with Main Civil Works, Generating Station and Spillways, Turbine & Generators, and
Balance of Plant, ensuring collaborative and transparent partnerships. Relationship management
activities include, but are not limited to, conducting meetings, leading discussions / negotiations,
and developing correspondence with contractor(s).
* Monitors contractor performance in relation to contractual terms and requirements, manage
contract interpretations and potential change orders, and manage disputes.
* Identifies contract management trends and forecasts potential contract changes, with a focus on
identifying high risk issues and claims patterns.
* Manages claims of significant size or any claims going to formal dispute, ensuring timely
responses through the dispute process, developing business cases and seeking senior leadership
and board approval for negotiating mandates as required.
* Develops resource strategies to ensure adequate commercial management resources and tools
are in place to meet objectives.
* Champions safety and is a role model for setting safety behaviors and standards.
* Leads a culture of continuous improvement in the development and administration of future
contracts from the learnings of claims experience and resolution.
* Provides people leadership by demonstrating BC Hydro values of Safety, Accountability,
Teamwork, Integrity, Service and Ingenuity and by providing performance management, career
planning support, coaching / mentorship, relevant succession planning.
